5. Disclosure of Information
Dockside does not sell your personal information for monetary consideration, and Dockside does not share your personal information for cross-context behavioral advertising (sometimes referred to as targeted advertising) in exchange for monetary consideration. Depending on how applicable state law defines "sale" or "share," however, certain disclosures described in this Section 5 (for example, to advertising or analytics partners through cookies) may be treated as a "sale" or "share" under such law. Your rights with respect to any such activity, including the right to opt out, are described in Section 15.

Where required by applicable law, Dockside obtains consent to non-essential Cookies through a Cookie banner, and you may revisit your Cookie preferences at any time. Dockside honors browser-based opt-out preference signals, such as the Global Privacy Control (GPC), as described in Section 16, to the extent required by applicable law. See Dockside’s separate Cookie Policy for additional information.

7.1 Transactional Communications
When you register, place a reservation, or receive Services, Dockside will send you transactional communications relating to your account, your reservations, and your deliveries, including reservation confirmations, dispatch and en-route notifications, delivery completion notices, invoices, receipts, and service alerts. You cannot opt out of these communications while maintaining an active account, although you may close your account as described in Section 15.
7.2 Marketing Communications
Dockside sends marketing emails and, where you have provided consent, marketing text messages. You may opt out of marketing emails at any time by clicking the "unsubscribe" link in any marketing email or by contacting Dockside as described in Section 19. You may opt out of marketing text messages by replying STOP to any such message. Opting out of marketing communications does not affect transactional communications.
7.3 Text Message Program Terms
If you provide a mobile telephone number, you consent to receive transactional and service-related text messages from Dockside, such as delivery dispatch notifications and delivery confirmations, at that number. Message and data rates may apply. Message frequency varies. Text HELP for help; text STOP to cancel. By providing a mobile number, you represent that you are the subscriber or customary user of that number and that you have authority to consent to text messages at that number. Dockside uses industry-standard practices, including applicable carrier and Telephone Consumer Protection Act compliant procedures, to manage opt-in and opt-out preferences.

If you participate in Dockside’s referral program, you may submit the name and contact information of another person to receive an invitation or promotional offer. By submitting another person’s information, you represent and warrant that: (a) you have a personal or business relationship with that person sufficient to support the referral; (b) you have obtained any consent required under applicable law, including the Telephone Consumer Protection Act and applicable state laws, to provide that person’s contact information to Dockside and to authorize Dockside to send an introductory communication; and (c) the information you provide is accurate.
Dockside will use the referred person’s information to send a one-time introductory message and, if that person registers for the Services, to associate the referral with your account for purposes of any referral incentive. Referred persons may opt out of further communications from Dockside at any time as described in Section 7. Dockside is not responsible for any claim arising from your provision of another person’s information to Dockside in violation of these conditions or applicable law, and you agree to indemnify Dockside in accordance with the Customer Service Agreement.
9. Precise Geolocation and Property Information
The Services inherently involve the collection and processing of precise geolocation information associated with delivery sites, customer property, vehicles, and vessels. Where these tools generate outputs that affect you, such as suggested delivery time windows or service-eligibility determinations, Dockside personnel review and have final responsibility for service decisions. Dockside does not make decisions producing legal or similarly significant effects regarding you based solely on automated processing without an opportunity for human review.
Dockside does not knowingly use customer communications or personal information to train third-party generative artificial intelligence models for purposes unrelated to the Services. Where Dockside engages artificial intelligence service providers, Dockside contractually restricts their use of information provided to them.
11. Operational Photographs and Delivery Records
As authorized in the Customer Service Agreement, Dockside personnel may take photographs of fuel meters, dispensing equipment, delivery sites, vehicles, vessels, and fuel containers in connection with deliveries. These photographs are retained as business records to document deliveries, verify volumes dispensed, and resolve disputes. Dockside does not intentionally photograph individuals and does not publish operational photographs in marketing materials without separate consent. Photographs are stored and protected consistent with the security measures described in Section 13.
12. Data Retention
Dockside retains personal information for as long as reasonably necessary to fulfill the purposes described in this Policy and to satisfy legal, regulatory, accounting, tax, insurance, dispute-resolution, and contractual obligations. Specific retention practices include the following general guidelines, which may be adjusted as reasonably necessary: (a) account and customer information is retained for the duration of your active account and for a reasonable period thereafter to support reactivation, recordkeeping, and dispute resolution; (b) transactional and delivery records, including invoices, receipts, meter readings, route data, and operational photographs, are retained for not less than the period required by applicable motor fuel tax, sales tax, and corporate recordkeeping laws; (c) communications are retained for a reasonable period to support customer service, audit, and dispute resolution; (d) marketing data is retained until you opt out or for a reasonable period thereafter as needed to honor your preferences; and (e) aggregated and de-identified data, which is not personal information, may be retained indefinitely.
When personal information is no longer required, Dockside will delete, destroy, or de-identify it consistent with its retention schedule and applicable law.
13. Data Security
Dockside maintains administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, and destruction. These safeguards include access controls and role-based permissions, encryption of payment data in transit, use of reputable third-party processors (including Stripe) for payment information, secure hosting environments, monitoring, and personnel training. Dockside requires service providers to implement appropriate safeguards consistent with their access to information.
No system is impenetrable, and Dockside cannot guarantee absolute security. You are responsible for safeguarding your account credentials and for promptly notifying Dockside of any suspected unauthorized access to your account.
14. Children
The Site and the Services are not directed to children under the age of 18. As provided in the Customer Service Agreement, customers must be at least eighteen (18) years of age. Dockside does not knowingly collect personal information from children under 18. If you believe a child has provided personal information to Dockside, please contact Dockside at the address in Section 19, and Dockside will take appropriate steps to delete the information.
15. Your Rights and Choices
Depending on where you reside, you may have certain rights with respect to your personal information, subject to applicable law and any exceptions provided by law. These rights may include: (a) the right to confirm whether Dockside processes personal information about you and to access such information and certain related details; (b) the right to request correction of inaccurate personal information; (c) the right to request deletion of personal information Dockside holds about you, subject to applicable exceptions; (d) the right to obtain a copy of certain personal information in a portable format; (e) the right to opt out of any sale or sharing of your personal information, or use for cross-context behavioral advertising, to the extent any such activity occurs; (f) the right to limit Dockside’s use of sensitive personal information to certain permitted purposes, where applicable; (g) the right to be free from unlawful discrimination for exercising any of these rights; and (h) where required by applicable law, the right to appeal a denial of your request.
Submitting a Request
You may submit a request to exercise these rights by contacting Dockside at privacy@docksidefuelservices.com or by using the contact information in Section 19. Dockside will verify your identity using information already on file, such as your account email, telephone number, and recent transaction history, before fulfilling your request. Dockside may decline to fulfill a request to the extent permitted by applicable law, including where verification is not possible or an exception applies. If Dockside denies your request, Dockside will explain the reasons and, where applicable, advise you of your right to appeal. You may use an authorized agent to submit a request on your behalf by providing the agent with written, signed permission and by verifying your own identity directly with Dockside. Dockside will deny requests from agents that do not provide proof of authority.
Closing Your Account
You may close your account at any time by contacting Dockside. Closing your account does not relieve you of payment obligations for Services rendered or for confirmed reservations subject to the Delivery Fee under the Customer Service Agreement.
